Relevant regulations

Foreign companies setting up companies in Taiwan can be divided into:

  1. Subsidiaries:A company organized and registered in accordance with the laws of our country for the purpose of profit. After pre-checking the company name with the Commerce Department of the Ministry of Economic Affairs, apply for an investment license from the Investment Review Committee of the Ministry of Economic Affairs, and then register the company establishment with the company registration authority.
  2. Branch:For profit-making purposes, a company registered in accordance with foreign law should first apply to the Department of Commerce of the Ministry of Economic Affairs for foreign company recognition and branch establishment registration (when establishing a branch in an export processing zone or a scientific industrial park, it should After approval by the Department of Commerce, apply for branch establishment registration) and profit-making enterprise registration (including factory establishment registration and import manufacturer registration) to the Export Processing Zone Management Office and Scientific Industrial Park Management Bureau of the Ministry of Economic Affairs.
  3. office:If a foreign company has no intention to establish a subsidiary or branch for business in China but needs to appoint a representative for legal business activities, it shall apply to the Department of Commerce of the Ministry of Economic Affairs for appointment in accordance with the provisions of Paragraph 1 of Article 386 of the Company Law. Reporting of the representative; if a permanent resident is required, a representative office shall be set up in accordance with the second paragraph of the same article.
